By accessing BulkGauge you agree to be bound by these Terms of Service and our Privacy Policy. If you are using the service on behalf of an organisation, you represent that you are authorised to bind that organisation.
You are responsible for safeguarding your account credentials and for all activity under your account. Each account owner may invite team members under fixed roles. We strongly recommend enabling two-factor authentication from your security settings.
BulkGauge is billed through Shopify. When you start a paid plan you approve a recurring charge in your Shopify admin, and Shopify collects it on our behalf and bills it to your Shopify invoice on each renewal date. You may change or cancel a plan at any time from Shopify or from BulkGauge; cancelling stops the next charge, and downgrades take effect at the end of the current billing period. Because the charge is Shopify’s, its billing schedule and any proration follow Shopify’s own rules. Payments are non-refundable except where required by law — see our Refund Policy. All fees are exclusive of applicable taxes unless stated otherwise.
You agree not to misuse the service, including by: (a) violating any applicable law or regulation; (b) attempting to gain unauthorized access to any system or network; (c) interfering with or disrupting the integrity or performance of the service; (d) transmitting malicious code; or (e) using the service to infringe the intellectual property or privacy rights of others. Violations may result in suspension of your account.
Your store data stays yours. We access it only to do what you ask — to preview a job, apply one, schedule one, undo one, and to keep the change history your plan provides. We act on your documented instructions, which are the jobs, schedules and settings you configure in the product, together with what is needed to run and secure the service or to comply with law. We do not use your store data for our own purposes and we do not use it to train machine-learning models. How we handle personal data, and the difference between store data and account data, is set out in our Privacy Policy.
We may suspend or terminate your account, with or without notice, if you breach these Terms, abuse the service, attempt to disrupt or reverse-engineer the platform, or use it for unlawful or fraudulent activity. You may close your account at any time from Settings; on closure, your data is scheduled for permanent deletion. Sections that by their nature should survive termination — including fees owed, limitation of liability, and governing law — continue to apply.
The service is provided "as is" and "as available", without warranties of any kind, express or implied. To the maximum extent permitted by law, ElAdawy LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, revenue, or business, arising from or related to your use of (or inability to use) the platform — even if advised of the possibility. Our total aggregate liability for any claim shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict-of-law provisions. Any legal action or proceeding against ElAdawy LLC arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to their jurisdiction.
We may update these Terms; material changes are notified in-app or by email, and continued use after the effective date constitutes acceptance.
